TERMS AND CONDITIONS
This page tells you about us and the legal terms and conditions (Terms) on which we sell any of the
products (Products) listed on our website (our site) to you.
These Terms will apply to any contract between us for the sale of Products to you (Contract). Please read
these Terms carefully before placing an order and make sure that you understand them. Please note that
by ordering any of our Products, you agree to be bound by these Terms.
OUR PRODUCTS
All Products shown on our site are subject to availability.
Products on our site are handmade and hand finished and as such may vary from the images shown on
our site. Although we have made every effort to display an accurate image of the products you are
purchasing, they may vary slightly from those images.
The packaging of the Products you receive may vary from that shown on the images on our site.
Our bakery does handle nuts & other allergens such as dairy, gluten & soya. We cannot guarantee that
traces of nuts, dairy, gluten, soya or other allergens will not be found in our products and therefore we
do not accept any liability for any damage to health or any distress caused to you by the consumption of
such Products.
YOUR PERSONAL INFORMATION
We will use your contact details solely for the purposes of processing your order. We will not send you
marketing emails, unless you have agreed to this. We will never pass your email address onto any other
company for marketing purposes. We fully adhere to the UK Data Protection Act.
We do reserve the right to publish photographs of your order onto our social media channels and our
website.
DELIVERY AND COLLECTION
Delivery is available via DPD next day delivery to most UK mainland areas. Please contact us if you are
unsure. We currently do not offer international delivery.
The Products ordered by you can only be delivered to the delivery address provided by you to us, or
collected by you from our bakery in Wroxton. Deliveries in the local area can be arranged at a small cost.
If for any reason no one is present to receive delivery of your order from the address provided, the item
may be left in a safe place as indicated by DPD. You will be given the option to amend your delivery
preferences by DPD once your order has been dispatched. DPD may require a signature and may not
deliver your item if no one is present to sign. Alternatively, they will take a photo on your premises.
Please note we cannot be held responsible for any deterioration in the product should this occur.
Once delivered, we are not responsible for your order and we shall not be liable for any delay in
delivering the Goods, however caused.
We cannot accept responsibility for damage caused by you or by a courier/agent engaged by you to
collect Products from us if they are damaged during transit to you.
We are not liable to you in respect of any complaint concerning any aspect of any Product which is not
raised by you within 24 hours of delivery by us or collection by you or your courier/agent. We will require
you to return any product to us for tasting and testing in the event of a complaint.
CANCELLATION AND REFUND POLICY
We are very confident that you will be delighted with your order. However, if on delivery of the products
you find that they are not those ordered by you or the order is incomplete, or a product is in a damaged
condition when you receive it, please notify us immediately by telephone on 01295738477 or email
info@tessbrilliantbakes.co.uk. Any faults or issues with an order must be reported on the day of
collection or delivery, otherwise we are unable to offer any refund.
We have a refund and replace policy at Tess’ Brilliant Bakes. Therefore, if a Product is not as on the Order
Confirmation or damaged we will credit or refund your purchase and send a replacement out to you. In
the case of damaged goods you must retain the damaged Products and all packaging for inspection by us
and also send photographic documentation of the order. Subject to our report on the claimed damage
and to these Terms and Conditions we will refund the price you paid for the returned Products together
with the delivery charge and replace the items as soon as possible.
We will only make a refund to the original credit card or debit card account used by you to make the
online purchase. Legal ownership of the goods will immediately revert to us if we refund any such
payment to you.
As taste is a very personal matter and subjective we cannot accept the return of any products merely
because you do not like the taste.
EVENTS OUTSIDE OUR CONTROL
We will not be liable or responsible for any failure to perform, or delay in performance of, any of our
obligations under a Contract that is caused by an Event Outside Our Control. An Event Outside Our
Control is defined below.
An Event Outside Our Control means any act or event beyond our reasonable control, including without
limitation strikes, lock-outs or other industrial action by third parties, civil commotion, riot, invasion,
terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for
war, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster, or failure of
public or private telecommunications networks or impossibility of the use of railways, shipping, aircraft,
motor transport or other means of public or private transport.
If an Event Outside Our Control takes place that affects the performance of our obligations under a
Contract:
(a) we will contact you as soon as reasonably possible to notify you; and
(b) our obligations under a Contract will be suspended and the time for performance of our obligations
will be extended for the duration of the Event Outside Our Control. Where the event Outside Our Control
affects our delivery of Products to you, we will arrange a new delivery date with you after the Event
Outside Our Control is over.
